EU and Competition

"a substantial EU and competition presence" (Legal Business, June 2006)

Berwin Leighton Paisner’s EU and Competition Law team includes leading practitioners with many years of experience of advising companies and other bodies across all major sectors on a wide range of EU and competition law issues. Areas covered include merger control; cartel investigations; abuse of dominance; EU single market issues; sectoral regulation; licensing, distribution and other commercial agreements; State aids and public procurement. We regularly represent clients before the Office of Fair Trading, Competition Commission, European Commission and other national regulatory authorities. We also advise and represent clients in litigation in the national courts and in the European Court of Justice and European Court of First Instance, as well as in their dealings with the European Parliament and European Ombudsman.

We use EU law proactively to solve clients’ problems, whether arising from EU law itself, from the way in which it is implemented at a national level or from national laws that are inconsistent with EU law. Our work may involve advising on the interpretation and application of Treaty provisions, discussions with relevant officials to highlight implementation issues or conflicts with national laws, influencing the EU legislative process or a combination of these strategies.

We take a practical, pro-active approach to addressing our clients’ competition and regulatory compliance needs and attach great importance to understanding their business and commercial objectives. We have excellent relations with the EU and national authorities at all levels, with members of our team having worked for the European Commission and served at a senior level in the OFT.
